1. Overview
These Terms & Conditions (“Terms”) govern all donations and ticket purchases made in support of Leaders of Change Foundation Ltd. (“the Foundation”, “we”, “us”, “our”). By donating or purchasing tickets, you agree to these Terms. The Foundation controls all funds collected and ensures their proper use and distribution in accordance with Australian charity law and our charitable purposes.
2. Fundraising Authority (Victoria)
The Foundation conducts fundraising in the State of Victoria and complies with applicable Victorian fundraising requirements and relevant national obligations for registered charities.
3. Scope of These Terms
These Terms apply to:
- Online and in-person donations processed by or on behalf of the Foundation; and
- Ticket purchases (general admission) for events promoted by or supporting the Foundation.
All funds collected are administered by the Foundation.
4. Nature of Payments: Donations vs Tickets
- Donations are voluntary gifts with no material benefit provided in return.
- Tickets provide access to an event (a material benefit). Tickets may include a disclosed donation component. Only the donation component (if applicable) may be tax-deductible—see Section 8.
5. Tickets, Seating & Admission
- All tickets are General Admission.
- Seating is allocated on the day on a first-in, best-dressed basis; please arrive early for the best seats.
- We may manage seating for safety, accessibility or production reasons. Admission is subject to venue conditions of entry.
6. Pricing, Fees & GST
- Ticket prices and any booking/merchant fees are displayed at checkout on our ticketing partner’s platform (summerfestival.org.au).
- GST treatment (if any) is applied in accordance with Australian taxation requirements relevant to charitable events.
7. Refunds, Cancellations & Changes
- Tickets are considered a donation and are non-refundable.
- Where required by Australian Consumer Law (e.g., event cancellation or major change by the organiser), lawful remedies will be provided.
- If the event is rescheduled, tickets will ordinarily be valid for the new date or a remedy will be communicated within a reasonable timeframe.
- Donations are generally non-refundable except in cases of processing error (e.g., duplicate charge, incorrect amount) or as otherwise required by law.
For any refund enquiries related to platform processing errors, please contact info@loc.charity.
8. Tax Deductibility
Donations of $2 or more may be tax-deductible in Australia where no material benefit is received. Where a ticket includes a disclosed donation component, only that component may be deductible. Official receipts will be issued electronically for eligible donations or donation components.
9. Fund Management & Distribution
All money collected (donations and net event proceeds) is controlled and distributed by the Foundation at its discretion in line with its charitable purposes, governance framework, and applicable laws. Where funds are raised for or with partner groups, distributions are made consistent with our charitable objectives and relevant agreements.
10. Receipts, Records & Reporting
We maintain appropriate financial and operational records for donations and ticketing, issue receipts electronically, and meet applicable reporting obligations.
11. Privacy & Data
We collect and handle personal information to process donations and tickets, issue receipts, and communicate about events and our work. Data is managed in accordance with the Privacy Act 1988 (Cth). For more detail, see our Privacy Policy. Our ticketing partner may also apply their own privacy terms on summerfestival.org.au.
12. Ticket Transfer, Resale & Conduct
- Tickets must not be resold above face value or used for promotions without written consent.
- We may refuse admission or remove any person for safety, security or disruptive behaviour.
- Minors must be accompanied by a responsible adult in accordance with venue policies.
13. Media, Photography & Recordings
The event may be photographed, filmed or recorded. By attending, you consent to incidental inclusion of your image/likeness in event documentation or promotion. If you have concerns, please contact us at info@loc.charity prior to the event.
14. Accessibility & Special Requirements
If you require accessibility accommodations, please contact us at info@loc.charity as early as possible so we can assist with reasonable arrangements.
15. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from participation in the event, donations, or ticket purchases. Nothing in these Terms limits your rights under the Australian Consumer Law.
